12. Section 4 of the Danish Pilotage Act shall not apply in the following cases:

Danish vessels flying a foreign flag which are entitled to perform the navigation in question without a pilot; and
-
vessels designed exclusively to carry liquid carbon dioxide in bulk and
-
offshore support vessels that according to international definitions carry the following products in bulk:
- Acetic acid
- hydrochloric acid
- hydrofluoric acid
- liquid carbon dioxide or
-
liquid nitrogen.
13. Section 4 of the Danish Pilotage Act shall not apply in the following waters:

Fanø Bay:
The waters to the south of 55°25'N and to the west of a NNE-SSW line going
through the 55°25'N-8°12,5'E point.

North Sea and Skagerrak:
The outer territorial waters to the north of 55°25'N and the west of 10°39'E if the vessel's distance from the base line exceeds three nautical miles.
-
Kattegat:
- The waters to the north of 57°39'N if the vessel's distance to the base line exceeds three nautical miles.
- Route A.
- Route B between 11°09'E and 12°31'E.
- Route T to the north of 56°29'N if the vessel's draught is less than 11 metres
-
Langeland Belt:
- Route H to the south of 54°48'N.

Route T to the south of 54°48'N if the vessel's draught is less than 11 metres.

The Baltic Sea:
The waters around Bornholm and Ertholmene if the vessel's distance to the base line exceeds three nautical miles.
Punishments for violations
The Danish Pilotage Act Section 34
A party who is in breach of section 4, subsection 1.......... , is punished by a fine or by imprisonment of up to one year.
Subsection 2. Both the ship's master and the ship's owner are punished if a certified pilot is not used in the instances described in section 4, subsection 1.
The Executive Order on the use of pilots article 15
Breach of the provisions of this executive order shall be punishable by a fine or up to twelve months' imprisonment.
(2) Legal entities shall be punishable under the provisions of Part 5 of the Danish Criminal Code. |
